Monly

Legal

Terms and Conditions

Effective September 26, 2026

These terms govern access to and use of Monly. By creating an account, sharing a payment link, or completing a payment, you agree to these terms.

1. Using Monly

You must be at least 18 years old, legally able to enter into a contract, and provide complete, accurate, and current information. You are responsible for protecting your account credentials, must not share them, and must notify us promptly of any suspected unauthorized access. You are responsible for activity performed through your account.

2. Services

Monly provides payment links, transaction records, and services related to receiving international payments and converting supported currencies into Colombian pesos. Availability, currencies, rates, limits, payment methods, and delivery options may change based on location, market conditions, compliance checks, or provider availability.

A displayed quote or estimated exchange rate is not guaranteed until Monly confirms the transaction. The final amount may reflect the rate, fees, and payment status shown before confirmation.

3. Payment links and fees

A payer chooses the amount and supported currency on a Monly payment link. The checkout displays the payment amount, a 4.5% service fee, and the total before the payer continues to the payment provider. By continuing, the payer authorizes the displayed total.

Online card payments are processed by FastSpring (Bright Market, LLC and FastSpring B.V.), which acts as the authorized reseller and merchant of record for the checkout. The payer's purchase is also subject to FastSpring's Terms of Sale and Privacy Policy, shown at checkout, and FastSpring's name may appear on the card statement. Monly does not receive or store complete card details.

Prices are shown in the selected currency. Your bank or card issuer may apply its own exchange or foreign-transaction charges, and applicable taxes may be calculated at checkout. Refunds and cancellations follow our Refund Policy.

Initiating an unjustified chargeback or payment dispute for a payment you authorized may lead to account restriction and recovery of related costs, without limiting your statutory rights, including payment reversal (reversión del pago) under Colombian law where applicable.

4. Acceptable use

You may not use Monly to:

  • Break the law, evade sanctions, taxes, or financial controls.
  • Commit fraud, misrepresent a transaction, or process unauthorized payments.
  • Sell prohibited goods or services, launder money, or finance illegal activity.
  • Interfere with the service, access another account, or misuse personal information.

5. Reviews, holds, and suspension

We may request information, review a payment, delay availability, reject a transaction, or restrict an account when reasonably necessary for security, legal compliance, fraud prevention, disputes, provider requirements, or suspected misuse.

6. Your responsibility

You are responsible for confirming recipient details, payment amounts, currencies, bank information, and transaction references before submitting them. Payment-link owners are responsible for the goods or services they offer and for resolving customer issues concerning those goods or services.

7. Service availability and liability

We work to keep Monly secure and available, but do not guarantee uninterrupted service or that third-party networks and providers will always be available. To the extent permitted by applicable law, Monly is not liable for indirect or consequential losses, market movements, provider outages, or losses caused by inaccurate information supplied by a user.

8. Intellectual property

Monly's name, logo, software, content, and design belong to Monly or its licensors. You receive a limited, non-exclusive, non-transferable right to use the service for its intended purpose. You may not copy, resell, reverse engineer, or create derivative works from it.

9. Indemnification

To the extent permitted by law, you agree to hold Monly harmless from claims, losses, and reasonable costs arising from your breach of these terms, your unlawful use of the service, or the goods or services you sell through a payment link.

10. Consumer rights

Nothing in these terms limits rights that cannot be waived under applicable consumer law, including Colombia's Consumer Statute (Law 1480 of 2011) and, where applicable, the right of withdrawal (retracto) and payment reversal. Complaints may be sent to us first and, if unresolved, to the Superintendence of Industry and Commerce (SIC).

11. Governing law and disputes

These terms are governed by the laws of the Republic of Colombia. Before starting a formal claim, you agree to contact us so we can try to resolve the dispute informally within 30 days. Otherwise, disputes will be resolved by the competent courts or authorities of Colombia, without prejudice to any mandatory consumer protections of your country of residence.

12. Changes and termination

We may update these terms to reflect changes to the service or applicable requirements. The version in effect when you place a payment applies to that payment, and the effective date will be updated when material changes are published. You may stop using Monly at any time, and we may suspend or terminate access for breach of these terms, subject to pending transactions, disputes, or legal retention duties.

13. General provisions

  • If any provision is found invalid, the remaining provisions remain in effect.
  • Our failure to enforce a provision is not a waiver of it.
  • You may not transfer your account or these terms without our consent; we may assign them in a reorganization or sale of the business.
  • Neither party is liable for delays caused by events beyond its reasonable control (force majeure).
  • These terms, the Privacy Policy, and the Refund Policy form the entire agreement. If the English and Spanish versions conflict, the Spanish version prevails for users in Colombia.
